Terms of Use

These terms govern your use of the BI Job Search website and application.

These Terms of Use (“Terms”) apply to the BI Job Search website at bijobsearch.com, the application at app.bijobsearch.com, and the related features, content and services made available through them (together, the “Service”).

The Service is operated by Vitamin Business Intelligence SASU, a French simplified joint-stock company with share capital of €5,000, registered under SIREN number 828 109 983, with its registered address at 17 Quai Victor Hugo, 11100 Narbonne, France (“BI Job Search”, “we”, “us” or “our”).

By creating an account, purchasing paid access or otherwise using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. What BI Job Search provides

BI Job Search is a specialist job-search and market-intelligence platform for people interested in Business Intelligence roles. Depending on your account and access level, the Service may allow you to:

  • search and filter Business Intelligence job listings;
  • create a skills profile;
  • view skills identified in job descriptions;
  • receive job-match information;
  • save jobs and searches;
  • view skills-demand analysis;
  • receive job alerts;
  • access employer names and application links; and
  • use other features that we may add, change or remove over time.

The Service currently focuses on job opportunities in the United States, United Kingdom and Canada. Geographic coverage may change.

2. No recruitment or employment relationship

BI Job Search is not an employer, recruitment agency or representative of the employers whose vacancies appear through the Service, unless we expressly state otherwise.

We do not participate in recruitment decisions and do not guarantee that you will receive an interview, response, job offer or employment. Any application or employment relationship is solely between you and the relevant employer, recruiter or job-listing provider.

3. Job information and third-party sources

Job listings and related information may originate from employers, recruitment companies, job boards, search providers, public sources or other third parties. Listings may be classified, filtered, deduplicated, normalised or enriched by our systems.

Although we take reasonable steps to improve relevance and quality, we do not guarantee that any listing or related information is accurate, complete, current, lawful, available or suitable for you. Vacancies may expire, be withdrawn, duplicated or changed without notice.

You should verify important information directly with the employer or on the external application page before applying, sharing personal data, relocating, resigning from employment or making any other career or financial decision.

External websites are controlled by third parties. We are not responsible for their availability, content, security, privacy practices, recruitment processes or actions.

4. Eligibility and younger users

The Service may be used by people of any age. However, if you are below the age at which you may legally enter into a contract or consent to the relevant processing of personal data in your country, you may use the Service only with the permission and, where legally required, the supervision of a parent or legal guardian.

A parent or legal guardian who permits a younger person to use the Service is responsible for that person’s use of the Service to the extent permitted by applicable law.

5. Accounts

Some features require an account. You must provide accurate information and keep it reasonably up to date.

Each account is personal to one individual. You must not share, transfer, sell, rent or allow another person to use your account or paid access. You are responsible for maintaining the confidentiality of your login details and for activity carried out through your account.

You must notify us promptly at adam@vitaminbi.com if you believe your account has been accessed without permission.

6. Free and paid access

The Service may contain free and paid features. The features included in each access level, the price, applicable taxes and the access period will be shown on the website, in the application or during checkout.

Paid access is currently offered as a one-time 60-day pass and does not renew automatically unless the checkout page expressly states otherwise. We may change prices, features or future access options, but a change will not reduce an access period you have already purchased except where reasonably necessary for security, legal or technical reasons.

Payment may be processed by a third-party payment provider. We do not receive or store your full payment-card details.

7. Refunds and service outages

Except where required by applicable law, payments for paid access are final and non-refundable.

If the paid Service is unavailable for more than 48 consecutive hours because of a technical failure within our reasonable control, you may contact us to request either:

  • a reasonable extension of your paid access period; or
  • a proportionate refund for the period during which the paid Service was unavailable.

This does not apply to interruptions caused by scheduled maintenance, third-party services, internet or device problems outside our control, misuse of the Service, suspension for breach of these Terms, or events beyond our reasonable control.

Nothing in these Terms excludes any refund, cancellation or other consumer right that cannot legally be excluded in your country or region.

8. Job alerts and communications

Job alerts and similar notifications are supplementary features. They may be delayed, incomplete, temporarily suspended or discontinued where technically or operationally necessary. We do not guarantee that every matching vacancy will appear in an alert or that an alert will arrive before a vacancy closes.

Service communications relating to your account, access, security, purchases or material changes to the Service may be sent where necessary. Marketing communications are handled separately and may be unsubscribed from using the method provided in the message.

9. Skills profiles, matching and automated analysis

Skills identification, classification, recommendations and match scores are generated using automated rules, data processing and, where applicable, artificial-intelligence systems. They are intended to help you explore opportunities and should not be treated as a definitive assessment of your suitability, qualifications or likelihood of being hired.

Employers do not receive your BI Job Search profile from us merely because you view or match with a listing. Information about how we process account, profile and usage data is provided in our Privacy Policy.

10. Acceptable use

You must not:

  • use the Service unlawfully, fraudulently or for a purpose unrelated to legitimate job search, career research or personal professional development;
  • share an account or give another person access to paid features;
  • copy, reproduce, republish, redistribute, sell, license or commercially exploit the Service or a substantial part of its job database;
  • scrape, crawl, harvest, download or extract listings or data through automated means without our prior written permission;
  • attempt to bypass access controls, paywalls, rate limits or security measures;
  • reverse engineer, probe, interfere with, overload or disrupt the Service;
  • introduce malware, malicious code or harmful content;
  • use another person’s identity or account without permission;
  • use information obtained through the Service to send spam, conduct unlawful discrimination or infringe another person’s rights; or
  • misrepresent BI Job Search as an employer, recruiter or source of a job offer.

Reasonable personal use includes viewing, saving and applying to jobs for your own purposes. It does not include building or enriching another job board, recruitment database, mailing list, research dataset or commercial product.

11. Intellectual property and database rights

The BI Job Search name, branding, website and application design, software, structure, taxonomies, classifications, original text, analysis, presentation and other materials created by us are owned by or licensed to Vitamin Business Intelligence SASU and are protected by applicable intellectual-property and database laws.

Employer names, logos, trademarks and original vacancy content remain the property of their respective owners. Their appearance does not imply sponsorship, endorsement or partnership.

We grant you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service in accordance with these Terms.

12. Suspension and termination

We may restrict, suspend or terminate access where we reasonably believe that:

  • these Terms have been breached;
  • an account is being shared, misused or accessed fraudulently;
  • the Service, other users or third parties face a security or legal risk;
  • payment has failed, been reversed or disputed improperly; or
  • suspension is necessary to comply with law or a binding request.

Where practical, we will provide notice and an opportunity to resolve the issue. Serious, repeated, fraudulent or security-related breaches may result in immediate suspension or termination without refund, except where applicable law requires otherwise.

13. Account deletion

You may request deletion of your account by contacting adam@vitaminbi.com. We may ask you to verify your identity before processing the request.

Deletion may not remove information that we are legally required to retain, such as certain payment, tax, fraud-prevention or dispute records. Further information is provided in our Privacy Policy.

14. Service availability and changes

We aim to provide a reliable Service but do not guarantee uninterrupted or error-free availability. Maintenance, updates, security work, supplier failures and circumstances outside our reasonable control may affect access.

We may add, change, suspend or remove features, sources, countries, classifications, limits or access options as the Service develops. Where a material change significantly affects paid access already purchased, we will take reasonable steps to minimise the impact or provide an appropriate remedy.

15. Disclaimers

The Service is provided on an “as available” basis. To the fullest extent permitted by applicable law, we do not make warranties that the Service will meet every requirement, identify every suitable vacancy, remain available at all times, or produce error-free classifications, skill matches or recommendations.

The Service provides information and tools, not legal, immigration, financial, recruitment or career advice. You remain responsible for evaluating vacancies, employers and application decisions.

16. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, or any mandatory consumer right that cannot be excluded.

Subject to the paragraph above, we are not responsible for indirect or consequential losses, loss of opportunity, loss of earnings, loss of employment prospects, loss of data, or losses arising from third-party listings, websites, employers, recruiters or services.

Subject to applicable law, our total liability arising from paid use of the Service will not exceed the amount you paid us for the access period giving rise to the claim. For free use, our total liability will not exceed €50.

17. Privacy and cookies

Our processing of personal data is described in the Privacy Policy. Where required, analytics cookies are used only after consent. Cookie preferences may apply across bijobsearch.com and app.bijobsearch.com.

18. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, security practices or business operations. The updated date will appear at the top of this page.

Where a change materially affects existing users, we will provide reasonable notice through the Service or by email. Continued use after the change takes effect constitutes acceptance of the updated Terms, except where applicable law requires a different form of consent.

19. Governing law and disputes

These Terms are governed by French law. The courts with jurisdiction under applicable law will have jurisdiction over disputes.

If you are a consumer, this choice of law does not deprive you of mandatory protections that apply under the laws of your country or region and cannot legally be waived by contract.

Before starting formal proceedings, you are encouraged to contact us so that we can try to resolve the matter informally.

20. General provisions

If part of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply. A delay in enforcing a right does not waive that right.

You may not transfer your rights or obligations under these Terms without our written permission. We may transfer these Terms as part of a reorganisation, sale, merger or transfer of the Service, provided that your mandatory rights are not reduced.

These Terms, together with any checkout terms and policies expressly incorporated by reference, form the agreement governing your use of the Service.
