Terms of Sale
These terms govern purchases of paid access to BI Job Search.
These Terms of Sale (“Sale Terms”) apply when you purchase paid access to the BI Job Search application at app.bijobsearch.com.
The seller is Vitamin Business Intelligence SASU, a French simplified joint-stock company with share capital of €5,000, registered under SIREN number 828 109 983, with its registered address at 17 Quai Victor Hugo, 11100 Narbonne, France (“BI Job Search”, “we”, “us” or “our”).
These Sale Terms supplement our Terms of Use. By placing an order, you agree to both documents. If there is a conflict relating specifically to a purchase, these Sale Terms take priority.
1. The paid service
Paid access unlocks the premium features described on the BI Job Search website, application and checkout page. These may include employer names, application links, job-match information, alerts and other premium functionality.
The current product is a one-time paid pass providing access for 60 consecutive days. The access period begins when payment is successfully completed and paid access is activated.
The exact features included at the time of purchase are those shown during checkout. Features may evolve, but we will not materially reduce an access period already purchased without providing an appropriate remedy where required.
2. Price and taxes
The current standard price of the 60-day pass is US$29. The price presented during checkout is the price that applies to your order.
Any applicable sales tax, value-added tax or similar charge will be shown during checkout where required. Currency-conversion fees or bank charges imposed by your payment provider are not controlled by BI Job Search.
We may change prices for future purchases. A price change will not affect access already purchased and paid for.
3. Ordering and contract formation
Before payment, you will be shown the essential characteristics of the paid access, the price, the access period and any applicable taxes.
By submitting payment, you make an offer to purchase the paid access shown at checkout. A contract is formed when payment is successfully authorised and we confirm or activate your paid access.
We may refuse or cancel an order before activation where:
- payment cannot be authorised;
- the price or product description contains an obvious error;
- we reasonably suspect fraud, misuse or unlawful activity;
- the purchase breaches our Terms of Use; or
- we are legally unable to provide the Service.
If we cancel an order after taking payment but before providing access, we will refund the amount paid.
4. Payment processing
Payments are processed securely by Stripe or another payment provider identified at checkout. The payment provider may apply its own terms and privacy policy.
You authorise the payment provider to charge the amount displayed at checkout using the payment method you provide. You confirm that you are authorised to use that payment method.
We do not receive or store your full payment-card number.
5. One-time purchase and no automatic renewal
The 60-day pass is a one-time purchase. It does not renew automatically and does not create a recurring subscription.
At the end of the access period, premium access expires automatically. Your account may remain available on the free tier, subject to the features offered at that time.
To continue using premium features after expiry, you must make a new purchase.
6. Immediate access
Paid access normally begins immediately after successful payment. By completing the purchase, you request that we begin supplying the paid Service without waiting for any statutory cancellation period to end.
Where applicable law provides a cancellation or withdrawal right, beginning the Service immediately may affect the amount refundable if you later cancel. Any mandatory rights that cannot legally be excluded remain unaffected.
7. Cancellation and withdrawal rights
Some consumers may have a statutory right to cancel an online purchase within a specified period, depending on where they live and how the Service is legally classified.
Where such a right applies and you request immediate access, we may be entitled to deduct or retain a proportionate amount for the Service provided before cancellation, to the extent permitted by applicable law.
To exercise a legally applicable cancellation right, email adam@vitaminbi.com and clearly state:
- your name and account email address;
- the date of purchase;
- that you wish to cancel the purchase; and
- any transaction or receipt reference available to you.
We will process valid statutory cancellation requests within the timeframe required by applicable law.
8. General refund policy
Except where required by applicable law or expressly provided in these Sale Terms, payments are final and non-refundable.
A refund is not normally provided because:
- you changed your mind after using the Service;
- you did not use the Service during the access period;
- you did not find a suitable job;
- you did not receive an interview, offer or employer response;
- a vacancy expired, changed or was removed;
- a job-match score or recommendation did not meet your expectations;
- you purchased access without first checking the available countries or features;
- you lost access because you breached the Terms of Use; or
- a problem was caused by your device, connection, browser, email provider or another service outside our control.
9. Service outage remedy
If the paid Service is unavailable for more than 48 consecutive hours because of a technical failure within our reasonable control, you may request either:
- a reasonable extension of your paid access period; or
- a proportionate refund for the period during which the paid Service was unavailable.
The outage period begins when the paid Service becomes generally unavailable and ends when reasonable access is restored. It does not include:
- scheduled or emergency maintenance;
- brief or intermittent interruptions that do not exceed 48 consecutive hours;
- failures of third-party websites, job boards, employers or application links;
- problems affecting only your device, browser, network or account configuration;
- access restrictions caused by misuse, fraud or breach of the Terms of Use;
- failures caused by services or infrastructure outside our reasonable control; or
- events beyond our reasonable control.
Requests must be sent to adam@vitaminbi.com within 30 days after the relevant outage ends.
10. Failed payments, disputes and chargebacks
Paid access may be withheld, suspended or removed if a payment fails, is reversed, refunded or disputed.
Before initiating a chargeback or payment dispute, please contact us so that we can investigate and attempt to resolve the issue. This does not limit any right you may have to dispute an unauthorised or incorrect charge through your payment provider.
We may provide the payment provider with relevant transaction, account-access and communication records when responding to a payment dispute.
11. Access activation and technical problems
Access is normally activated automatically after successful payment. If payment is confirmed but premium access does not appear, contact adam@vitaminbi.com using the email address associated with your account.
You are responsible for using a supported browser, maintaining an internet connection and keeping your account credentials secure.
12. Job data and expected results
Purchasing access does not guarantee a minimum number of job listings, suitable vacancies, employer responses, interviews, offers or employment outcomes.
Job information is obtained from third-party sources and may change, expire or contain errors. Paid access provides access to BI Job Search features and information; it is not a recruitment service or guarantee of employment.
13. Changes to paid features
We may improve, replace or discontinue individual features as the Service develops. We may also change job sources, geographic coverage, matching methods and alert functionality.
If a material change significantly reduces the core value of paid access you have already purchased, we will provide an appropriate remedy where reasonably required, such as an extension, alternative feature or proportionate refund.
14. Consumer guarantees and mandatory rights
Nothing in these Sale Terms excludes, restricts or replaces a consumer guarantee, cancellation right, refund right or other protection that applicable law does not allow us to exclude.
If there is a conflict between these Sale Terms and a mandatory consumer protection applicable to you, the mandatory protection takes priority.
15. Limitation of liability
Liability relating to use of the Service is subject to the limitations set out in our Terms of Use.
Nothing in these Sale Terms limits liability where doing so would be unlawful, including liability for fraud or any mandatory consumer right that cannot be excluded.
16. Governing law and disputes
These Sale Terms are governed by French law. The courts with jurisdiction under applicable law will have jurisdiction over disputes.
If you are a consumer, this choice of law does not deprive you of mandatory protections that apply under the laws of your country or region and cannot legally be waived.
Before starting formal proceedings, please contact us so that we can try to resolve the matter informally.
17. Changes to these Sale Terms
We may update these Sale Terms for future purchases to reflect changes in the Service, pricing, payment methods, law or business operations.
The Sale Terms in force when you place an order govern that purchase, unless a later change is required by law or is more favourable to you.
